Sex offender Terry Albers must serve another 360 days in jail for sexual abuse of girl

MINOT, N.D. – Terry Lee Albers, 62, Douglas, will be sent back to jail to serve another 360 days for sexually abusing a girl over a decade ago.

Albers had pleaded guilty in December to one count of Class A felony gross sexual imposition in exchange for a plea deal that would have sentenced him to time already served in the Ward County Jail plus five years of supervised probation. He had originally been charged with two counts of Class AA felony sexual imposition and accused of sexually abusing two girls, but the state agreed to dismiss one of the charges and amend the other to the lesser charge of Class A felony gross sexual imposition. He was already a convicted sex offender at the time of the crime and has been required to register as a sex offender.

He served 252 days in jail before he was allowed to be released on house arrest and GPS monitoring in November 2020 because of his poor health.

During the sentencing hearing on Wednesday, a relative of the victims spoke about the enormous damage done to the girls by Albers and called for a harsher sentence. She called the proposed sentence “a slap on the wrist.”

Judge Richard Hagar said he doesn’t like to second guess the prosecution and noted that the prosecution had made the plea offer based on its assessment of the strength of the evidence. But Hagar said he would not accept the plea deal and would require that Albers serve the additional 360 days in jail. Hagar gave Albers the opportunity to withdraw his guilty plea but Albers decided he would accept the amendment and serve the additional time in jail. Hagar will give Albers until April 23 to report to the Ward County Jail to give Albers time to get vaccinated against COVID-19.
