MINOT, N.D. – Kaleb Patrick Thomas Frey, 20, Minot, was sentenced on Thursday to 360 days in jail, all suspended but the three days he already served in the Ward County Jail, and two years supervised probation for burglarizing the Ground Round on May 12 while wearing a shirt over his head. His co-defendant, Perfecto Ramos Jr., 18, waived his right to a probable cause hearing at the same hearing on Thursday and entered a not guilty plea to Class C felony burglary.

Judge Gary Lee also ordered Frey to stay away from the Ground Round, to pay $525 in court costs and restitution yet to be determined for the Class C felony burglary and Class A misdemeanor wearing a mask during the commission of a crime charges. The Class C felony will be reduced to a Class A misdemeanor if Frey successfully completes probation. He was given a concurrent sentence of three days for wearing the mask in commission of an offense.

According to the probable cause affidavit filed with the court, Frey ran from the Ground Round and was caught and detained. He was carrying a tire iron in one hand and a crow bar in the other. When he was stopped and searched, officers also found nitrate gloves along with marijuana and paraphernalia.

Ramos was later caught hiding in a shed in the backyard of a southeast Minot residence and was arrested and charged.

A south door at the Ground Round had pry marks and a safe also had pry marks on it. The office appeared to have been searched. Cash drawers were pulled out and a jar of change was on the counter.
